1. About Us

These Website Terms and Conditions ("Terms") govern your use of the Hire4Holidays website and the holiday equipment rental services offered through it. By accessing our website or placing a booking, you agree to be bound by these Terms.

2. Acceptance of Terms

By accessing or using the Hire4Holidays website, creating a customer account, or placing a rental booking, you confirm that you:

• • Are at least 18 years of age;
• • Have the legal capacity to enter into a binding contract under Spanish law;
• • Have read, understood, and agree to be bound by these Terms in full;
• • Agree to our Privacy Policy, which is incorporated into these Terms by reference.

If you do not agree to these Terms, you must not use our website or services. Hire4Holidays reserves the right to update or amend these Terms at any time. The current version will always be published on our website with the effective date shown above. Continued use of our website following any update constitutes acceptance of the revised Terms.

3. Our Services

Hire4Holidays provides a delivery-and-collection holiday equipment rental service across the Costa del Sol, Spain. We do not operate a walk-in shop; all rental items are delivered to and collected from the customer's chosen address within our operating area; Sotogrande to San Pedro.

Our rental inventory covers the following categories:

• • Beach equipment (umbrellas, chairs, loungers, tents, carts, cooler boxes, beach toy sets)
• • Baby and infant equipment (travel cots, bed rails, baby baths, bath supports, bath seats, rockers, sterilisers, high-chairs, step stools, toilet training seats, potties, infant paddling pools)
• • Sports and activity equipment (paddle boards, surfboards, bodyboards, kayak kits, snorkelling sets, adult and children's bicycles, balance bikes, scooters, fishing rod sets, paddle rackets, hiking poles)
• • Mobility equipment (mobility scooters, wheelchairs, walking frames, walking poles)
• • Electronics (air fryers, smart TVs, computer monitors, bluetooth speakers, baby bottle warmers, blenders, coffee machines)

As demand grows, we may add further items to our inventory. All items listed on our website are subject to availability at the time of booking.

4. Customer Accounts

You may create a customer account on our Booqable-powered booking platform to manage your bookings and rental history. By creating an account you agree to:

• • Provide accurate, complete, and up-to-date information at all times;
• • Keep your login credentials secure and not share them with any third party;
• • Notify us immediately at [email protected] if you suspect any unauthorised access to your account;
• • Accept responsibility for all activity and bookings made through your account.

Hire4Holidays reserves the right to suspend or terminate any account where we have reason to believe that these Terms have been breached, or where fraudulent or abusive activity is suspected.

5. Bookings & Minimum Rental Period

All bookings are made through our website via the Booqable booking platform. A booking constitutes an offer by you to rent the selected equipment, which is accepted by Hire4Holidays upon confirmation of your booking and payment.

Minimum Rental Period

All equipment is subject to a minimum rental period of three (3) consecutive days. We do not offer single-day or two-day rental periods. Bookings for fewer than three days will not be accepted.

Delivery & Collection

Hire4Holidays operates on a delivery-and-collection basis only. At the time of booking, you will be asked to provide:

• • Your delivery address within our Costa del Sol operating area;
• • Your preferred delivery date.
• • Your preferred collection date.

Delivery and collection times are subject to availability and operational capacity. We will contact you by phone or WhatsApp on the delivery & collection day to advise you of approximate delivery and collection time. You will be asked to sign a rental agreement upon delivery of equipment.

Equipment Availability & Substitution

All bookings are subject to equipment availability. If a specific item you have booked becomes unavailable due to unforeseen circumstances (including damage, mechanical failure, or prior rental conflict), Hire4Holidays reserves the right to:

• • Substitute the unavailable item with an equivalent or superior item of the same category at no additional charge; or
• • Offer you the option to cancel the affected item from your booking and receive a full refund for that item.

We will notify you of any substitution or unavailability as early as possible. Where a substitution is not acceptable to you, a full refund for the affected item will be provided. Hire4Holidays shall have no further liability in such circumstances.

6. Payment

Full payment is required at the time of booking. We accept major credit and debit cards through our secure Booqable-integrated payment platform. All transactions are processed in Euros (€).

Security Deposits

Rental items may be subject to security deposits. These are shown on the product page and at check-out.

Deposits are taken by credit or debit card pre-authorisation. The pre-authorisation is not a charge — it is a temporary hold on your available credit. The deposit will be released in full upon collection of equipment by Hire4Holidays, provided the equipment is returned in satisfactory condition. Any damage, loss, or charges for breach of these Terms may be deducted from the deposit prior to release.

All prices displayed on our website are inclusive of applicable Spanish IVA (VAT) unless otherwise stated.

7. Cancellation & Refund Policy

Cancellation by the Customer

You may cancel your booking at any time prior to the scheduled delivery date, subject to the following conditions:

Cancellations must be made through the website or in writing by email to [email protected]. The cancellation time is calculated from the moment Hire4Holidays receives and acknowledges your written cancellation request.

Cancellation by Hire4Holidays

In exceptional circumstances (including but not limited to severe weather, force majeure, or circumstances beyond our reasonable control), Hire4Holidays may need to cancel or postpone a booking. In such cases you will be offered either a full refund or the option to reschedule at no additional charge. Hire4Holidays shall have no further liability to you beyond the return of any amounts paid.

8. Late Returns

Equipment must be available for collection by Hire4Holidays on the agreed collection date.

If equipment is not available for collection at the agreed time without prior authorisation from Hire4Holidays, the following will apply:

• • Additional rental charges will be applied at the standard daily rate for each day or part day beyond the agreed return date;
• • Hire4Holidays reserves the right to charge these additional amounts to the payment card used for the original booking;
• • Persistent or unreasonable delays in returning equipment may be treated as loss or theft and may be reported to the Spanish police authorities.

9. Customer Responsibilities & Acceptable Use

By placing a booking with Hire4Holidays you agree to the following responsibilities in relation to all rented equipment:

• • To use all equipment safely, responsibly, and in accordance with its intended purpose;
• • Not to use any equipment whilst under the influence of alcohol, drugs, or any substance that may impair your ability to operate it safely;
• • Not to sub-rent, lend, or transfer equipment to any third party;
• • To comply with all applicable Spanish laws, local regulations, and safety requirements relevant to the use of the equipment;
• • To keep all equipment secure when not in use and to take reasonable precautions against loss, theft, or damage;
• • To report any damage, fault, or loss to Hire4Holidays as soon as it occurs;
• • To ensure that safety helmets (provided with all bicycle rentals) and life vests (provided with all applicable water sports equipment) are worn at all times during use.

Detailed use restrictions for specific equipment categories (bicycles, water sports equipment, mobility scooters, and baby equipment) are set out in the Equipment Rental Agreement which customers are required to sign upon delivery of equipment.

10. Damage, Loss & Theft

The customer is responsible for all equipment from the point of delivery until collection by Hire4Holidays. This includes responsibility for:

• • Any damage beyond fair wear and tear, howsoever caused during the rental period;
• • Any loss or theft of equipment during the rental period.

In the event of theft, the customer must obtain a formal police report (denuncia) from the Spanish police (Policía Nacional or Guardia Civil) and provide a copy to Hire4Holidays. Without a valid denuncia, the customer will be held fully liable for the replacement cost of the equipment.

The cost of repair or replacement of damaged or lost equipment will be charged to the customer. Where a security deposit has been held, Hire4Holidays will apply the deposit against such costs. Where costs exceed the deposit amount, Hire4Holidays reserves the right to pursue recovery of the outstanding balance.

11. Limitation of Liability

To the fullest extent permitted by applicable Spanish law, Hire4Holidays shall not be liable for:

• • Any personal injury arising from misuse of equipment, use in breach of these Terms, or failure to follow safety instructions;
• • Any injury or loss resulting from use of equipment in adverse weather conditions, red-flag beach conditions, or in conditions contrary to these Terms;
• • Any loss, theft, or damage to the customer's personal belongings during the rental period;
• • Any indirect, consequential, or economic loss arising from equipment unavailability, failure, or delay.

12. Use of Our Website

You agree to use the Hire4Holidays website only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use and enjoyment of the website. You must not:

• • Use the website in any way that could damage, disable, overburden, or impair it;
• • Attempt to gain unauthorised access to any part of the website, its systems, or databases;
• • Use automated tools, bots, or scrapers to access or extract content from the website;
• • Transmit any unsolicited commercial communications or spam through the website;
• • Upload or transmit any malicious code, viruses, or harmful software.

13. Privacy & Data Protection

Hire4Holidays takes your privacy seriously. The collection, use, and storage of your personal data is governed by our Privacy Policy, which is available on our website and is incorporated into these Terms by reference.

By using our website and making a booking, you acknowledge that we will process your personal data (including your name, address, phone number, email address, and payment card details) in accordance with our Privacy Policy and applicable Spanish and EU data protection law (GDPR and LOPDGDD 3/2018).

14. Cookies

Our website uses cookies to improve your browsing experience and to support the functionality of our booking platform. Our use of cookies is governed by our separate Cookie Policy, which is available on our website. By continuing to use our website you consent to our use of cookies in accordance with that policy.

15. Third Party Services

Our booking system is operated through Booqable (booqable.com), a third-party rental management platform. Payment processing is handled by Booqable's integrated payment partners. By making a booking you will be subject to Booqable's own terms of service and privacy policy in addition to these Terms.

Hire4Holidays is not responsible for the content, availability, or practices of any third-party websites or services linked to or from our website. Links to third-party websites are provided for convenience only and do not constitute an endorsement.

16. Changes to Services & Pricing

Hire4Holidays reserves the right to add, modify, or withdraw any item from our rental inventory at any time. Where additions or changes are made to the inventory, these will be reflected on our website. As demand grows we may expand the quantities of certain product lines — such changes do not affect the Terms applicable to existing bookings.

Prices displayed on our website are subject to change. However, the price confirmed at the time of your booking will always be honoured for that booking, regardless of any subsequent price changes.

17. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of Spain. Any dispute arising out of or in connection with these Terms or your use of our website and services shall be subject to the exclusive jurisdiction of the Courts of Málaga Province, Spain.

Customers who are consumers resident in another EU member state retain the right to bring proceedings in the courts of their country of residence, in accordance with applicable EU consumer protection legislation.
